I think you should be fine. Apart from this scenario on the other extreme you could start working for the new company with just the receipt number as well. You dont need to wait for the approval to start working for the new company.

I was wondering If I can start H1B visa transfer to the new company via premium processing(hopefully will get approved in 2-3 weeks) and continue to work for the current employer and get paid till the end of May, even the though the transfer would have been approved in the end of April.

My labour was filed for a software engineer position (java, udb, etc) 3 years ago. Over that time, my role has changed to a project manager. Infact I don't do any coding anymore. If I invoke AC21 after 180 days, can I switch to a Project Manager position?

Yes, she can travel on H4 stamping. Also let her carry AP if need arises.
I am on H1 (Has EAD but never used it), my wife is on H4 and also she has H4 stamping till Feb 2010, She got EAD and and also got SSN. But she never worked on EAD. Now she want to travel to India
Can she travel on H4 stamping or she need to get AP

There is a 245(K) provision that will save your wife - research that and ask your attorney to file 485 for her with that.

I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?
Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!

I have current passport with valid I94, my lawyer asks for copy of all expired passport which has visas on it. But I ccannot find the expired passport, can I still file the I485. I appreciate your help.

I am on AOS and currently working on my EAD. If I lose the job and employer terminates the health insurance, then will I qualify for the COBRA coverage or is it strictly for the Greencard/citizens? Any info is greatly helpful.

The only answer to your question is:"it depends". Who are your state's Senators and how interested/influential are they in immigration issues? Same question for whoever is the Congressperson for your district. I don't think any there is any harm in contacting both Senators as well as the Congressperson for your district.

My spouse got her GC in Sep/2000 filed by her parents. Then went back to India to continue studies with 2 yr permission from INS. Return to US after 2 yr and stayed for 8 months in US and then took trip again back to India for 7 months. And then return back in May/2004 and still here since then.
Outline:
Got GC -- Sep/2000
out of US (Nov/2000 - Oct/2002) with permission from INS or USCIS.
Return to US -- Nov/2002
Stayed 10 months in US
Trip to India --- Sep/2003 (for 7 months)
Return to US -- April/2004
Since April / 2004 here in US.
based on this stasts we my spouse apply for citizenship.
USCIS work sheet eligibility says >> 5 yr GC ->> If not out for 30 months in last 5 yr (true) >> No trip out side of US more then 1 yr. (FALSE - If so execpetion -- took permission - true) >> good moral >> etc., >> APPLY FOR CITIZENSHIP.
But when read the eligi. requir. its says absence more then 1 yr cancel all previous contin. of stay ??? confused with this both understanding.....

Anyone of you who has been fingerprinted and had interview with USCIS,
How long did you take to be given a schedued appointment for interview after the fingerprint? Did you have an interview right after the fingerprint?
Is that possible to have it both on the same day?
I am asking you because I would like to travel outside of the country with AP as soon as I have my fingerprint done.
If I would be nortified of the interview date right after the figerprint, I would rather stay to finish everything before travel. That way, I won't cause any troubles, right?

Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.
Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�
Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

Consult a good lawyer, prepare an appropriate reply based on true situation. If they feel that the request is genuine, they will approve else be prepared for the worst.
To be frank, i don't think any company like the one you explained even exists! I will be surprised if it does, and if it does I won't wonder if there is no RFE in the current enforcement days from USCIS.
